This Marketplace Policy governs the use of the marketplace services (the “Marketplace”) provided by GOLDFINCH (“we”, “us”, “our”). It applies to all users who buy, sell, list, or otherwise interact with products or services on the Marketplace.

By accessing or using the Marketplace, you agree to comply with this Policy, our Terms and Conditions, and any other applicable policies.

1. About the Marketplace

GOLDFINCH operates an online platform that enables third-party sellers (“Sellers”) to list and sell goods and/or services to buyers (“Buyers”).
Unless expressly stated otherwise, we are not a party to transactions between Buyers and Sellers.

2. Eligibility

To use the Marketplace, you must:

  • Be at least 18 years old

  • Have the legal capacity to enter into binding contracts

  • Comply with all applicable UK laws and regulations

  • Provide accurate, current, and complete account information

We reserve the right to suspend or terminate access if eligibility requirements are not met.

3. Seller Obligations

Sellers must:

  • Provide accurate, complete, and truthful listings

  • Clearly describe goods or services, including price, condition, delivery terms, and any applicable restrictions

  • Ensure all goods and services comply with UK law, including:

    • Consumer Protection from Unfair Trading Regulations 2008

    • Consumer Rights Act 2015

    • Product safety and labelling requirements

  • Fulfil orders promptly and professionally

  • Honour refunds, cancellations, and returns in line with UK consumer law

Sellers are solely responsible for their listings, transactions, and customer service.

4. Buyer Obligations

Buyers must:

  • Provide accurate payment and delivery information

  • Pay for purchases promptly

  • Communicate with Sellers respectfully and in good faith

  • Use dispute processes fairly and honestly

5. Prohibited Items and Activities

The following are strictly prohibited on the Marketplace:

  • Illegal or stolen goods

  • Drugs, controlled substances, or drug paraphernalia

  • Weapons, firearms, ammunition, or explosives

  • Counterfeit or infringing goods

  • Unsafe or recalled products

  • Items that promote hate, violence, or discrimination

  • Items restricted by UK law without proper authorisation

 

  • 5.2 Prohibited Conduct

  • Fraud, misrepresentation, or deceptive practices

  • Circumventing Marketplace fees

  • Harassment, abuse, or threatening behaviour

  • Manipulating ratings or reviews

  • Using the Marketplace for unlawful purposes

We may remove listings or accounts without notice where prohibited items or conduct are identified.

6. Fees and Payments

  • Any applicable Marketplace fees will be clearly disclosed

  • Sellers are responsible for all applicable taxes unless stated otherwise

  • Payment processing may be handled by third-party providers subject to their terms

7. Returns, Refunds, and Cancellations

  • Buyers located in the UK may have statutory rights under the Consumer Contracts Regulations 2013

  • Sellers must comply with all mandatory consumer rights, including cooling-off periods where applicable

  • Disputes should first be addressed directly between Buyer and Seller

  • We may, at our discretion, assist with dispute resolution but do not guarantee outcomes.

8. Reviews and Feedback

  • Reviews must be honest, accurate, and based on genuine experiences

  • We may remove reviews that are abusive, misleading, or violate this Policy

  • Reviews are the opinions of users and not endorsed by us

9. Enforcement

  • We reserve the right to:

  • Remove listings or content

  • Suspend or terminate accounts

  • Withhold payments where fraud or policy breaches are suspected

  • Report illegal activity to relevant UK authorities

  • Enforcement decisions are made at our discretion.

10. Limitation of Liability

  • To the maximum extent permitted by law:

  • We are not responsible for the quality, safety, legality, or delivery of items listed

  • We are not liable for losses arising from transactions between Buyers and Sellers

  • Nothing in this Policy limits liability that cannot be excluded under UK law.

11. Changes to This Policy

  • We may update this Marketplace Policy from time to time. Continued use of the Marketplace after changes take effect constitutes acceptance of the revised Policy.

12. Governing Law and Jurisdiction

  • This Policy and any disputes arising from it shall be governed by and construed in accordance with the laws of England and Wales.
    The courts of England and Wales shall have exclusive jurisdiction.
